Keep the soil where the plan says it goes.
Construction-phase control built to pass first review, and permanent shoreline work that stops the bank from moving into somebody's back yard.
Two different jobs that share a failure mode. One happens while a site is open and inspected weekly. The other happens over years, quietly, until a nor'easter makes it everyone's problem.
During construction
Delaware's sediment and stormwater program runs under 7 DE Admin. Code 5101 and is administered through delegated agencies — for this market, the Sussex and Kent conservation districts. Land disturbance of an acre or more needs coverage under the construction general permit, with the electronic notice of intent filed before plan approval.
Several things changed at the start of 2026. Computations now require NOAA rainfall distribution curves. Plans approved after January 1 must use the standard details marked "Effective January 2026." The stormwater fee-in-lieu rose to $27 per cubic foot of required storage volume. A plan drawn to last year's details is a plan that comes back.
- E&S plan implementation and construction-phase inspection
- Coordination with the district reviewer, through the comments
- Slope stabilization, matting and permanent seeding at closeout
Permanent shoreline and channel work
Wave action and fluctuating water levels undercut a bank at the toe. The slope calves, the safety bench narrows, roots get exposed, and the top of bank starts migrating toward the nearest lot line. Once it reaches one, it stops being a landscaping problem.
There is usually more than one way to fix it, and the hard-armour option is not automatically the right one. The 2026 federal nationwide permits revised the bank-stabilization permit to favor soft, vegetated, nature-based approaches — which is also frequently the cheaper and better-looking answer on a residential pond.
- Shoreline stabilization: riprap, bioengineering and living shorelines
- Streambank and outfall channel repair
- Outlet protection replacement where the apron has worked loose or silted over
Shoreline restoration is priced by the linear foot, and the number of linear feet grows on its own. The same bank repaired early is a planting and grading job; left to keep calving, it becomes an engineered structure with a permit attached.
